PATIENT INFORMATION NOTICE ON THE PROCESSING AND PROTECTION OF PERSONAL DATA

This information notice, prepared to inform you about the processing, transfer, storage, and disposal of your personal information shared during the healthcare services provided to you by Assoc. Prof. Dr. Ali RESUL, is hereby submitted to the attention of our valued patients.

Within the scope of the legislation, personal information and the personal details of special information that may be specific to healthcare services may be recorded, archived, updated, transferred, classified, and processed in the manner that can be explained in this information notice, in the ways set forth in the Turkish Data Protection Law (“KVKK”) and the relevant legislation.

1. Data Controller

This information is provided by Assoc. Prof. Dr. Ali RESUL in accordance with Law No. 6698 on the Protection of Personal Data (“KVKK”), Law No. 3359 on Basic Health Services, Decree Law No. 663 on the Organization and Duties of the Ministry of Health and Its Institutions, the Regulation on Private Hospitals, the Regulation on the Processing of Personal Health Data and the Protection of Privacy, the regulations of the Ministry of Health, and in relation to the responsibility for healthcare services.

As the data controller, all kinds of personal data shared by you are stored by acting in compliance with all applicable legislation in force, with due regard to patient privacy, and by taking all necessary technical and administrative measures to ensure the provision of appropriate security units regarding personal data.

2. Personal Data Collected by Us

We collect various information from our Website visitors within the scope of the online services we provide and from our patients who visit the clinic. Your personal data may be processed in a manner that is related to, limited to, and proportionate with the purposes specified in Article III below, including but not limited to the following;

  • Identity Information : Your name, surname, Turkish Republic ID number, passport number or temporary Turkish Republic ID number, place and date of birth, marital status, gender, insurance or patient protocol number, and other identity data through which we may identify you..
  • Contact Information : Your address, phone number, e-mail address and other contact data, your voice call records kept by customer representatives or patient services due to call center standards, and your personal data obtained when you contact us via e-mail, letter or other means.
  • Financial Information : :Your financial data such as your billing information.
  • Camera Records : If you visit our clinic, your camera recording images taken in common areas for security and audit purposes.
  • Health Information : :Your examination data, data regarding your medical history, data regarding your family medical history, your laboratory results, your medical imaging results, your test results, your examination appointment information, your prescription information, your clinical follow-up videos. All meetings and correspondence made with your doctor in digital environments (E-mail, SMS, social media, digital messaging platforms, etc.) during the pre-examination consultation, diagnosis, treatment and follow-up process. All information notices and consent forms presented to you prior to the procedure. Your health data recorded at other healthcare institutions and deemed medically necessary to be included in your file at our clinic are also within this scope. Your personal data relating to social, family and sexual life obtained during the conduct of medical diagnosis, treatment and care services or as a result thereof are within this scope.
  • Genetic Data : Your genetic disorders included in the genetic test.
  • Your Insurance Information : Your data relating to private health insurance and your Social Security Institution data for the purpose of financing and planning healthcare services.
  • Visual Records : 3D photographs and videos taken before – during – after the procedure were recorded.

3. Purposes of Processing Personal Data

  • Your personal data obtained by Assoc. Prof. Dr. Ali RESUL will be used for the purpose of providing you with an effective, safe, and high-quality healthcare service. Among the purposes of processing your personal data are verifying your identity, ensuring doctor-patient communication, protecting public health, preventive medicine, planning and carrying out medical diagnosis, treatment and care services effectively, planning and managing the financing of healthcare services, planning and managing the internal functioning and daily operations of our clinic, and the supply of medicines and materials. If you make an appointment at our clinic, your contact data may be used in order to inform you about the appointment.
  • Your personal data may be used for the purposes of carrying out quality improvement activities, training and development of our employees, ensuring patient and employee safety, monitoring unauthorized transactions, measuring patient satisfaction, improving healthcare services, and fulfilling legal and regulatory requirements.
  • Your personal data may be processed for the purposes of verifying your relationship with the institutions with which we have agreements, issuing invoices in return for our healthcare services, and sharing requested information with private insurance companies within the scope of financing healthcare services.
  • Your personal data may be used for the purposes of sharing requested information with the Ministry of Health and relevant public institutions and organizations pursuant to the relevant legislation, providing necessary information in line with the requests and audits of regulatory and supervisory authorities and official authorities, storing information regarding your health data that must be kept pursuant to the relevant legislation, and responding to any questions and complaints regarding our healthcare services.
  • Pursuant to the relevant legislation, your personal data obtained and processed may be transferred to physical archives and information systems belonging to Assoc. Prof. Dr. Ali RESUL and may be stored under protection both in digital and physical environments.
  • However, your personal data will not be used for any commercial purpose under any circumstances other than the activities listed above and the cases required by the relevant legislation.

4. Method of Collection of Personal Data and Legal Grounds

Your personal data are obtained in any verbal, written, visual, and electronic environment for the purposes stated above and in order for healthcare services to be provided within the determined legal framework and, in this context, for Assoc. Prof. Dr. Ali RESUL to be able to fully and duly perform his contractual and legal obligations. The legal grounds for the collection of your personal data are the provisions of the KVKK and other applicable legislation.

Your personal data are processed by Assoc. Prof. Dr. Ali RESUL, in accordance with Article 5/1 of the KVKK where you have given your explicit consent, and, in accordance with Article 5/2 of the KVKK;

  • Explicitly stipulated in laws,
  • Where it is mandatory to process your personal data for the protection of your or someone else’s life or physical integrity in cases where you are unable to declare your consent due to actual impossibility or where your consent is not legally recognized,
  • Provided that it is directly related to the establishment or performance of a contract, the processing of personal data of the parties to the contract is necessary,
  • Where it is mandatory for the data controller to fulfill its legal obligation,
  • The personal data have been made public by the data subject,
  • Data processing is mandatory for the establishment, exercise, or protection of a right,
  • Provided that it does not harm your fundamental rights and freedoms, data processing is mandatory for the legitimate interests of the data controller

and are processed by automatic and non-automatic methods based on these legal grounds.

Pursuant to Article 6/1 of the KVKK, special categories of personal data may be processed if explicit consent is obtained. Pursuant to Article 6/3 of the KVKK, personal data relating to health and sexual life may be processed without seeking the explicit consent of the data subject by persons under a duty of confidentiality or authorized institutions and organizations, for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, and planning and managing healthcare services and their financing. Within this scope, pursuant to Article 6/3 of the KVKK, during the healthcare services provided by Assoc. Prof. Dr. Ali RESUL, your personal health data may be processed for the purposes of protecting public health, preventive medicine, carrying out medical diagnosis, treatment and care services, and planning and managing healthcare services and their financing.

Your personal data are obtained during the healthcare services provided by Assoc. Prof. Dr. Ali RESUL, and the obtaining of personal data may take place during face-to-face meetings as well as via telephone, website, e-mail, and digital messaging platforms.

5. Transfer of Personal Data

In cases where the legislation mandates it and where you have given your written consent, it is possible to share your personal data with third parties and institutions for the purposes set forth in Article III of this Information Notice, by ensuring that all necessary technical and administrative measures are taken to provide an appropriate level of security in accordance with the KVKK and the relevant health legislation.

Such third parties/institutions include persons, institutions, organizations, banks, private insurance companies, funds, auditors, consultants, business partners, organizations from which we contractually receive services, to which we provide services, and with which we cooperate to carry out our activities, and other natural and legal third parties, as permitted by the KVKK and other relevant legislative provisions.

In addition, your personal data within the scope of camera records may be transferred to judicial authorities or relevant law enforcement units in order to resolve legal disputes or upon request pursuant to the relevant legislation.

6. Your Rights Regarding the Protection of Personal Data

As the data subject;

  • To learn whether your personal data are processed in accordance with the relevant legislation,
  • If your personal data have been processed, to request information regarding such processing, to access and request your personal health data,
  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
  • To know the third parties to whom personal data are transferred domestically or abroad,
  • To request the correction of personal data if they are processed incompletely or inaccurately,
  • To request the deletion or destruction of personal data; and, if personal data have been processed incompletely or inaccurately, to request the correction and/or deletion or destruction of personal data and to request that the transactions carried out in this scope be notified to third parties to whom personal data have been transferred,
  • To object to the occurrence of a result against the person by analyzing the processed data exclusively through automated systems, and to request compensation in case of suffering damage due to the unlawful processing of personal data, it is presented for your information that you have these rights.

If you exercise your rights to learn whether personal data are processed, to request information if your personal data have been processed, to access and request your personal data, to learn the purpose of processing your personal data and whether they are used in accordance with their purpose, and to know the third parties to whom your personal data are transferred domestically or abroad, the information you request will be notified to you in writing, electronically, or via the contact information provided by you.

7. Data Security and Right to Apply

Personal climate control, within technical and administrative means, ensures that the data are protected and that the necessary security measures are provided at a level appropriate to possible risks, taking technological capabilities into account.

You may submit your requests within the scope of the KVKK by filling out the “ Application Form Within the Scope of the Law on the Protection of Personal Data ” on the “www.aliseyitresul.com ” web address;
